Purpose and legal basis of personal data processing

In case of recruitment aimed at employment under an employment contract:

Your personal data disclosed in the submitted application will be processed for the following purposes:  (A) to comply with the duties specified in law and related to the recruitment process – the legal basis is the legal duty imposed on the Company (Art. 6.1.c of the General Data Protection Regulation No.  2016/679 (hereinafter: Regulation 2016/679) in connection with the provisions of the Labour Code) (B) to perform the recruitment process related to data that is not required by law, the legal basis for processing is the consent (Art. 61.1.a of Regulation 2016/679) (C) for future recruitment processes if consent is provided to process data for the purpose – the legal basis for processing is the consent (Art. 61.1.a of Regulation 2016/679); (D) for identifying and pursuing any claims or for defence against such claims by the Controller – the legal basis for data processing is the Controller's legitimate interest (Art. 6.1.f of Regulation 2016/679)

In case of recruitment aimed at employment under a civil law contract:

Your personal data disclosed in the submitted application will be processed for the following purposes: (A) for purposes related to the recruitment process – the legal basis for processing is Art. 61.1.b of Regulation 2016/679)  (B) to perform the recruitment process related to data provided on a voluntary basis - the legal basis for processing is the consent (Art. 61.1.a of Regulation 2016/679) (C) for future recruitment processes if consent is provided to process data for the purpose – the legal basis for processing is the consent (Art. 61.1.a of Regulation 2016/679); (D) for identifying and pursuing any claims or for defence against such claims by the Controller – the legal basis for data processing is the Controller's legitimate interest (Art. 6.1.f of Regulation 2016/679)

 

Categories of data recipients (entities processing data on behalf of the Controller)

Your personal data may be disclosed to the entities providing services to the Company in connection with recruitment processes such as recruitment portals and providers of recruitment IT systems;

 

Storage period of personal data

Your personal data will be stored until the end of the recruitment process and selection of a candidate by the Company.  If your data is processed on the basis of your consent, your data will be processed until the consent is revoked.  When you have provided your consent for data processing for future recruitments, your data will be processed for maximum 6 months.  The processing period may be extended by the expiry period of claims if your personal data needs to be processed to determine and pursue potential claims or to defend against such claims by the Company.  Afterwards, your data will be processed solely to the extent and for the time required by law, including accounting regulations;

 

Rights of the data subjects:

·         Your consent may be revoked at any time. Your consent may be revoked in the consent management panel. Access to the panel may be obtained by applying for such access or by clicking on the link with the token sent in the e-mail by the recruiter.  Such revocation of the consent shall not affect the lawfulness of processing performed before it is revoked;

·         You have the following rights: access to your data and demand that it is corrected, deleted, the processing  is restricted, the right to have your personal data transferred and the right to object to processing of your personal data on the basis of the Controller’s legitimate interests in view of specific circumstances unless processing is required by law;  the right to file complaints to the supervisory authority - President of the Data Protection Bureau - PUODO.

·         Your personal data will not be profiled;

You may exercise your rights inter alia by contact with the Personal Data Inspector (the address is provided above) or by contact to: HR.Office@ringieraxelspringer.pl (title of the message: “Personal Data”).

The disclosure of your personal data is required by the Labour Code (employment on the basis of an employment contract) and required for recruitment purposes (employment on the basis of a civil law contract). Failure to disclose personal data will prevent the review of your application related to the recruitment process.  In case of data not required by the Labour Code, the data is provided on a voluntary basis and no consent or revocation of the consent will not result in an unfavourable treatment of the person applying for employment and may not generate any negative consequences - in particular, it will not be used as a reason justifying refusal of employment.
